Preamble:
These General Terms and Conditions (hereinafter referred to as "Consumer Terms and Conditions") define the rights and obligations of the Seller and the Buyer (hereinafter referred to as the "Buyer") arising from the purchase agreement, the subject of which is the purchase and sale of goods through the Seller's online store www.recorder.sk.

Article I. General Provisions

1.1. The Buyer under these conditions is a natural person who does not act within the scope of their business activity or profession when concluding and performing the purchase agreement.

1.2. A consumer, under § 2(a) of Act No. 250/2007 Z. z. on Consumer Protection, is a natural person who does not act within the scope of their business activity or profession.

1.3. The Buyer provides the Seller with the following personal data: name, surname, residential address, email address, phone number, and other data necessary for concluding the agreement and delivering the goods.

1.4. These General Terms and Conditions form an integral part of the purchase agreement. If the Seller and the Buyer enter into a written purchase agreement with different conditions, the terms of the written agreement shall prevail over these General Terms and Conditions.

Article II. Conclusion of the Purchase Agreement

2.1. The purchase agreement is concluded upon the seller's binding confirmation of the buyer's order. Orders can be placed through the seller's online store, via email, or by phone.

2.2. The binding order confirmation includes information about the product specification, price, delivery method, delivery time, and payment method. The seller sends the confirmation to the buyer's email address provided during the order placement.

2.3. The buyer is obliged to provide truthful information necessary for the proper processing of the order. The seller is not responsible for errors caused by incorrect or incomplete order details provided by the buyer.

2.4. If the ordered goods are unavailable, the seller must promptly inform the buyer and offer an alternative solution or allow the buyer to withdraw from the agreement.

Article III. Rights and Obligations of the Seller

3.1. The seller is obliged to:

  • deliver the goods to the buyer in the agreed quantity, quality, and time after the agreement is concluded,
  • ensure that the goods comply with applicable legal regulations,
  • provide the buyer with an invoice, delivery note, and other documents necessary for receiving and using the goods.

3.2. The seller has the right to:

  • receive timely and proper payment for the goods from the buyer,
  • withdraw from the agreement if the buyer fails to fulfill their obligations, particularly in cases of non-payment within the specified deadline.

Article IV. Rights and Obligations of the Buyer

4.1. The buyer is obliged to:

  • pay the seller the agreed purchase price, including delivery costs,
  • accept the ordered goods in accordance with the agreed conditions,
  • provide the seller with accurate information necessary for the delivery of the goods.

4.2. The buyer has the right to:

  • receive the goods in the agreed quantity, quality, and time,
  • obtain information about the status of the order,
  • withdraw from the agreement in accordance with applicable legal regulations.

Article V. Delivery and Payment Terms

5.1. Delivery terms:

  • The standard delivery time is 1-5 working days.
  • Goods located in external warehouses may be delivered within 15 working days.
  • The buyer will be informed of any delays in delivery under exceptional circumstances.

5.2. Delivery methods:

  • Express delivery by courier to the address: €5.90 (1-2 working days).
  • Standard delivery by courier to the address: €3.90 (3-4 working days).
  • Collection at the pickup point (GLS): €5.90 (1-2 working days).
  • Collection at the pickup point (Packeta): €3.40 (3-4 working days).
  • Personal pickup at the Recorder office (Karadžičova 8/A, Bratislava): €0.00.

5.3. Payment methods:

  • Bank transfer to the seller's account.
  • Card payment via Stripe service.
  • Cash payment is available only for personal pickup at Karadžičova 8/A, Bratislava.

Article VI. Warranty and Claims

6.1. Warranty:

  • A statutory warranty of 24 months from the date of receipt of the goods is provided for all products unless otherwise specified in the product description.
  • A 12-month warranty is provided for used goods.

6.2. Claims:

  • The buyer must notify the seller of discovered defects as soon as possible after their discovery.
  • Claims can be submitted by email to info@recorder.sk or by mail to Karadžičova 8/A, 82108 Bratislava.
  • The claim must include a detailed description of the defect, a copy of the purchase document, and a correctly completed claim form, available at www.recorder.sk.

Article VII. Transfer of Ownership and Risk of Damage

7.1. Transfer of Ownership:

  • Ownership of the goods is transferred to the buyer upon full payment and receipt of the goods.

7.2. Transfer of Risk:

  • The risk of damage to the goods passes to the buyer when the buyer or a person authorized by them receives the goods.

Article VII. Transfer of Ownership and Risk of Damage

7.1. Transfer of Ownership:

  • Ownership of the goods is transferred to the buyer upon full payment and receipt of the goods.

7.2. Transfer of Risk:

  • The risk of damage to the goods passes to the buyer when the buyer or a person authorized by them receives the goods.

Article VIII. Complaints

8.1. Liability for Defects:

  • The seller is responsible for defects in the goods in accordance with the applicable laws of the Slovak Republic.

8.2. Submitting a Complaint:

  • The buyer has the right to file a complaint within 24 months of receiving the goods unless a different period is stated in the product description. Complaints are submitted via the complaint form available on the seller's website.

8.3. Complaint Processing:

  • The seller must process the complaint within 30 days of its receipt. If complaint processing requires technical analysis, this period may be extended, with the seller notifying the buyer in writing.

8.4. Buyer’s Obligations:

  • The buyer must provide proof of purchase, a completed complaint form, and the complained goods in the original or suitable packaging.

Article IX. Personal Data Protection

9.1. Personal Data Protection Rules:

  • The seller processes the buyer’s personal data in accordance with the GDPR and Act No. 18/2018 Z. z. on Personal Data Protection.

9.2. Scope of Processed Data:

  • Personal data processed by the seller includes name, surname, address, email, phone number, and other data necessary for contract fulfillment.

9.3. Purpose of Data Processing:

  • Personal data is processed for contract fulfillment, product delivery, handling complaints, and sending marketing information if the buyer has given explicit consent.

9.4. Buyer’s Rights:

  • The buyer has the right to access, rectify, delete, restrict processing, and transfer their personal data.

Article X. Withdrawal from the Purchase Agreement

10.1. Right to Withdraw from the Agreement

The buyer has the right to withdraw from the agreement within 14 days without giving any reason in accordance with § 7 of Act No. 102/2014 Coll. on consumer protection in distance sales. The withdrawal period begins on the day the goods are received by the buyer or a third party designated by them.

10.2. Conditions and Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to:

  • Goods made to order or customized to the buyer’s specific requirements.
  • Digital content delivered online if its delivery has been expressly agreed to by the buyer.
  • Used goods that have been excessively worn, damaged, or lack declared components.

10.3. Exercising the Right of Withdrawal

The buyer may exercise their right of withdrawal as follows:

  • By completing the withdrawal form available on the seller's website.
  • By sending the completed form electronically to info@recorder.sk or by post to the seller's address (Karadžičova 8/A, 821 08 Bratislava).
  • The withdrawal notice must include the order identification, the date of receipt, and contact details for further communication.

 


Rules for Returning Used Goods

10.4. Conditions for Returning Used Goods

  • Used goods can be returned if the following conditions are met:
    • They do not have additional damages that were not part of the original description at the time of purchase.
    • All declared components and accessories are included.
    • They are properly packaged for return shipping.

10.5. Buyer Obligations for Returning Used Goods

  • The buyer must return the goods to the seller’s address (Karadžičova 8/A, 821 08 Bratislava) within 14 days of notifying the seller of the withdrawal.
  • The buyer bears the costs of return shipping unless otherwise agreed.

10.6. Seller Obligations for Returning Used Goods

  • The seller must refund the buyer, considering:
    • The original purchase price of the goods.
    • Any reduction in value caused by wear or damage.
  • Refunds will be issued within 14 days of the seller receiving the returned goods.

 


Rules for Returning New Goods

10.7. Conditions for Returning New Goods

  • New goods can be returned only if:
    • They are in their original, unused, and complete condition.
    • They include original packaging and all accessories.

10.8. Buyer Obligations for Returning New Goods

  • The buyer must return the goods to the seller’s address (Karadžičova 8/A, 821 08 Bratislava) within 14 days of notifying the seller of the withdrawal.
  • The buyer bears the costs of return shipping unless otherwise agreed.

10.9. Seller Obligations for Returning New Goods

  • The seller must refund the full amount paid by the buyer, including delivery costs (except for extra costs arising from the buyer’s choice of a more expensive delivery method).
  • Refunds will be issued within 14 days of the seller receiving the returned goods.

10.10. Consequences of Non-Compliance with Conditions

  • If the buyer returns new goods that are incomplete, without original packaging, or damaged, the seller has the right to:
    • Deduct a reasonable amount from the refund to cover the cost of restoring the goods to their original condition.
    • Reject the return if the damage is irreparable.

Article XI. Alternative Dispute Resolution

11.1. Right to Alternative Dispute Resolution:

  • The buyer has the right to contact the seller with a request for a resolution if they are dissatisfied with how the seller handled their complaint or if they believe the seller has violated their rights.

11.2. Filing a Request for Dispute Resolution:

  • The buyer can file a request for alternative dispute resolution with the relevant authority if the seller rejected the request or failed to respond within 30 days of its submission.
